If you allowed another person to occupy your home within 12 months from the date you occupied your home or you allowed someone else to occupy your Principal Place of Residence (PPR), you may be liable for further transfer duty due to non-compliance with the original transfer duty home/first home concession conditions.
If you received the First Home Owner Grant on the home you now wish to rent out or grant exclusive possession to another party (in full or part), you need to be aware of the following to avoid the requirement to repay the grant or be liable for additional duty that was forgone due to non-compliance with your original FHOG conditions:

- If you rent your home out, or grant exclusive possession to another party (in full or part) of your PPR within the first 12 months of the date on which you first occupied your property as your home, you may be liable to further duty.
- If you extend an existing lease or tenancy agreement to tenants (under an existing tenancy arrangement entered into with the vendor), you may be liable to further duty.
