Transfer duty may be waived for land transactions that are entered into for settlement of native title claims. This is limited to land used solely or almost solely by or for native title claimants for traditional or residential purposes. Land used for commercial purposes is not eligible.

To apply, you must include:
- a statutory declaration (PDF 25 K)
- all the documentation required by the Commissioner under the Duties Act 2001 and Taxation Administration Act 2001 (for example, transfer documentation, valuations where necessary and approved forms).
