If you are purchasing an existing home you must commence occupation of the home within 1 year after the transfer is registered with the Department of Natural Resources and Water.
If you have entered into a contract to have a home built or are an owner builder, you must commence occupation of the home within 1 year after the building is ready for occupation as a home and any prescribed completion requirements are complied with (ie. final inspection has been completed).
However, section 15 of the First Home Owner Grant Act 2000 allows the Commissioner of State Revenue to exercise discretion where an applicant requires a longer period for which to move into the home. There must be good reason for this discretion to be applied. The Commissioner is also able to exempt applications from this requirement if the following conditions are met:
- the applicant is 1 of 2 or more joint applicants for a first home owner grant; and
- at least 1 of the applicants complies with the residence requirement; and
- the commissioner is satisfied there are good reasons to exempt the applicant from the residence requirement.
Each matter is considered on a case-by-case basis. Contacting OSR as soon as you are aware that you will be unable to meet the residence requirements is the most important obligation and should be strictly adhered to.
