Definition of terms—Fuel Subsidy

These definitions are provided as a general guide. For legal definitions, see the relevant sections of the repealed Fuel Subsidy Act 1997 (the Act).

BEU (bulk end user) fuel

BEU fuel is non-retail fuel that is delivered into the BEU’s vehicle or equipment running tanks—either from their storage site, or directly from a distributor in Queensland. Each delivery to a BEU must not exceed 2,000 litres in a day. The fuel must be used by the BEU for operating their vehicle or equipment, except for an off-road purpose.

Conditional registration

Conditional registration means conditional registration under a regulation under the Transport Operations (Road Use Management) Act 1995.

Diesel engine road vehicle

A diesel engine road vehicle is a vehicle that satisfies all of the conditions below:

  1. has a diesel engine
  2. travels on a public road
  3. is not conditionally registered or would not qualify for conditional registration.

Eligible fuel purchase

Eligible fuel purchases are fuel purchases that can be subsidised under the act. This includes:

(a) retail fuel—fuel purchased from a retailer (see definition)

and

(b) bulk end user fuel—non-retail fuel delivered to a person’s storage tanks or the running tanks of their vehicles by a distributor. Bulk end user fuel does not include diesel used for an off-road purpose.

‘Bulk end user (BEU) fuel’ is defined in section 6 of the Act and ‘retail fuel’ is defined under section 10.

Fuel

Fuel is

(a) motor spirit and diesel of the type ordinarily sold by a retailer

or

(b) another type of motor spirit or diesel that can be used in a vehicle as a replacement for fuel mentioned above, and is the subject of a fuel standard in force under the Fuel Quality Standards Act 2000 (Cwlth)

‘Fuel’ is defined in Schedule 2 of the Act.

Fuel distributors

A fuel distributor is a person who sells fuel in Queensland, and is not a retailer for the fuel sold.

Marine (purpose)

Diesel used either on a vessel, or by a vessel, that ordinarily travels by sea.

Motor spirit

Motor spirit means ‘petrol’.

Off-road purpose

An off-road purpose (relating to diesel) means a purpose other than to propel a diesel engine road vehicle on a public road. For diesel purchased from a retailer, an off-road purpose does not include a private or domestic purpose.

Provisional payment

A provisional payment is a payment of subsidy in advance, which can be made to retailers or BEUs to assist them with cash flow, as opposed to claiming the subsidy in arrears.

Provisional subsidy is referred to in section 18 for retailers and section 34B for BEUs.

Recreational ship

A recreational ship is a ship registered for recreational purposes under the Transport Operations (Marine Safety) Act 1994.

Retail fuel

Retail fuel is fuel sold by a retailer from their site (e.g. a petrol station). The quantity of the sale of fuel for an individual vehicle must not exceed 2,000 litres in a day, and must be delivered by a metered pump into either the running tank of the vehicle, or an empty container. Diesel used for a commercial off-road purpose is not retail fuel.

Retailer

A retailer sells fuel that they own to the public from a fixed site in Queensland.

Subsidised price

The subsidised price of fuel is the price charged after the subsidy has been deducted.
