Free trade, wine and opium Acts

The following Acts were inherited from New South Wales, and were in force in Queensland, after separation in 1859.

Both the long title and preamble of the Acts are given.

All 3 Acts were repealed by the Queensland Government when it enacted the Customs Duties Act of 1870.

Free trade

An Act to permit goods the produce or manufacture of New Zealand or Van Dieman’s Land to be imported into the Colony of New South Wales free of duty and to indemnify certain officers for acts already done [30th June 1842]

Preamble

WHEREAS New Zealand has been recently formed into a separate and independent colony and whereas the free importation into New South Wales of goods and manufactures the produce of New Zealand or Van Dieman’s Land may be productive of considerable commercial advantages to the trade as well of New South Wales as of both those colonies Be it therefore enacted by His Excellency the Governor of New South Wales with the advice of the Legislative Council thereof That from and after the passing this Act all goods and commodities (except spirituous liquors cordials or liqueurs) being the growth produce or manufacture of Van Dieman’s Land or of New Zealand may be imported into the Colony of New South Wales free of any duty.

Wine

An Act to authorise the issue of wine duty free to military officers serving in the Colony of New South Wales [19th June 1844]

Preamble

WHEREAS it is expedient to allow wine intended for the consumption of military or naval officers serving on full pay in New South Wales or the adjoining seas to be imported into the said colony or taken out of bond for that purpose duty free Be it therefore enacted by his Excellency the Governor of New South Wales with the advice and consent of the Legislative Council thereof That it shall be lawful for the Governor of New South Wales or the officer administering the government to order any wines to be delivered from any vessel or taken out of bond free of duty on such proof being adduced as the said Governor or officer administering the government may require that such wines are bona fide intended for the consumption of such naval or military officers serving on full pay as aforesaid.

Opium

An Act for granting a duty of customs on opium [20th November 1857]

Preamble

WHEREAS it is expedient to grant to Her Majesty a duty of customs upon opium  Be it therefore enacted by the Queen’s Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows ...
